Avoiding Charges of “Patient Abandonment” “Patient abandonment,” a potentially devastating charge that haunts every healthcare professional, can be avoided quite easily by following established policies and procedures. Whenever the doctor chooses not to accept a patient, or to stop treating an existing patient, he or she would simply follow established procedures as described in this course to ensure that the patient’s best interests are served and the doctor does not invite a charge of “abandonment.”

Description: The Professional Assistance Program Instructor: Stephen T. Eble, DC State Legislation in 1986 as a confidential, treatment- based alterative to disciplinary proceedings. The Professional Assistance Program (PAP) is available to professionals licensed under Title VIII of the Education Law except physicians, physician assistants, and specialist assistants. Professionals whose actions have not resulted in patient harm, may voluntarily surrender their licenses while seeking treatment for the disease of addiction. The statute that created the PAP also established a committee on drugs and alcohol abuse to advise the Board of Regents on matters related to practice by professional licensees who have drug or alcohol abuse problems. The Board of Regents appoints members to the Committee. The professional with the disease of addiction benefits from potential consideration of reduction of charges or penalties in possible State Education Department, Department of Health or criminal proceedings. Immunity granted from the Education Department include: practicing while impaired and being a habitual user of drugs or alcohol. The professional’s license is reinstatement by the Committee and the monitoring period begins. Monitoring is a process of the collection and reporting of data to determine abstinence from alcohol and other drugs and to support recovery.
